Terms of service
These General Conditions of Sale concern the purchase of MASSIMO RATTALINO products carried out remotely via electronic network on the website shopmassimorattalino.it, belonging to Rattalino Massimo, with headquarters in Strada Giro del Mondo 4, 12050 Barbaresco (CN).
Each purchase transaction will be governed by the provisions of the Legislative Decree. 185/99, Legislative Decree. 206/05; the information aimed at the conclusion of the contract will be subject to the art. 12 of the Legislative Decree. 70/03 and, as regards the protection of confidentiality, it will be subject to the legislation referred to in Legislative Decree. 196/03.
Access to the Site is permitted only to those over 18 years of age.
THE SALE OF ALCOHOLIC PRODUCTS IS FORBIDDEN TO MINORS.
Users of the website www.shopmassimorattalino.it declare that they are adults according to the legislation applicable to them. If there is no legislation in this regard, you must be at least 21 years old.
Conclusion of the contract and acceptance of the Conditions of Sale
The sales contracts for the products on our site are considered concluded when the purchase order placed by the customer is received and accepted by the seller. We will promptly send the customer the receipt of the purchase order placed. By sending their purchase order electronically, the customer declares to have read and accepted these general contract conditions and undertakes to observe and respect them.
Customer Obligations
The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and acceptance.

Definition of the order
By sending the online order, the Customer sends MASSIMO RATTALINO di Rattalino M. a proposal to purchase the product and/or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Conditions of Sale. We will communicate to the Customer the acceptance and confirmation of the order.
Purchase method
The customer purchases the product, the characteristics of which are illustrated online in the relevant descriptive and technical data sheets, at the price indicated therein to which any delivery costs specified on the site are added. Before submitting the purchase order, the unit cost of each selected product, the overall cost in the case of purchasing multiple products and any delivery costs are summarized.
All retail prices include VAT and do not include any taxes or duties applicable in the country of destination of the products and/or services where this is different from Italy.
These costs, which differ from country to country, are borne by the Customer, who is responsible for verifying the amount with the competent customs authorities.
Once the purchase order has been submitted, the customer will receive an email confirming receipt of the purchase order and containing information relating to the main characteristics of the purchased good, a detailed indication of the price, delivery costs, taxes (if applicable) and means of payment, as well as a reference to the general contract conditions and information regarding the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site.
Following the approval of Legislative Decree 4 July 2006 n. 223 "bis maneuver" Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which came into force on 12 August 2006, with which the obligation to communicate the list of customers and suppliers is reinstated in the event of an invoice being issued, and of Legislative Decree 78 of 31 May 2010 converted into Law 122 of 30 July 2010, imposes the need to ask customers to communicate their VAT number and TAX CODE in the appropriate fields on the site.
Accepted payment methods
The customer can make the payment due by choosing one of the following methods listed:
Mastercard, Visa, American Express, Paypal, Apple Pay, Google Pay, Amazon Pay and other local payment methods accepted by Shopify Payments.
It is not necessary to create an account to proceed with the order.
Delivery of products
The purchased good is delivered by courier to the address specified by the Customer when ordering online. Currently the shipment of our products is only available to addresses located in Italy. In the event of non-delivery due to the absence of the recipient, the courier will leave a notice at the address indicated in the order and will try again a second time; if the recipient is still absent, the goods will be returned to the sender (MASSIMO RATTALINO).

Conformity guarantee
All products marketed enjoy the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code which covers any defects in conformity of the items purchased, existing at the time of delivery and which appear within 2 years of delivery itself. Any defects or damage caused by accidental events or by the Customer's responsibility for use of the products that do not conform to their intended use, or as a result of normal wear and tear, are excluded from defects of conformity and, therefore, from the legal guarantee.
For the purposes of this contract, it is presumed that the consumer goods comply with the contract if, where relevant, the following circumstances coexist:
a) they are suitable for the use for which goods of the same type are usually used;
b) they conform to the description made by the seller and possess the qualities of the good that the seller has presented to the consumer as a model through photographs on the Site;
c) they present the usual quality and performance of a good of the same type, which the consumer can reasonably expect.
In the event of a lack of conformity, the consumer may request, alternatively and without charge, under the conditions indicated on the Site, the replacement of the purchased good or a reduction in the purchase price.
The request must be sent in written form via email to info@massimorattalino.it who will indicate his availability to process the request, or the reasons that prevent him from doing so, within seven working days of receipt.
The consumer customer has no right to terminate the contract if the lack of conformity is only minor.
Defective goods / Damaged shipment
In the case of defective goods:
the same can be returned to shopmassimorattalino.com within 14 days of delivery.
The shipping costs for returning the purchased goods are always paid by the customer.
Defective goods will be replaced or refunded (if they are out of stock) once received by us and assessed for non-conformity.
In the case of damaged shipping:
if you receive packages that are visibly damaged by the courier (packages broken or visibly stained by wine leaking from any broken bottles) you can do the following:
- If there are multiple packages, return the damaged package to the sender by signing the courier's note "With Reserve". We will then take care of returning the damaged package and sending it back to you.
- If it is a single package shipment, reject the shipment to the sender and, as before, we will take care of the return and restoration of the shipment.

Online dispute resolution
Pursuant to European Union Regulation no. 524/2013, the Consumer resident in Europe is informed that the European Commission has established an online platform that provides an alternative dispute resolution tool.
This tool can be used by the European Consumer to resolve non-judicially any dispute relating to contracts for the sale of goods and services stipulated online and/or deriving from them. Complaints
For any complaints or clarifications, the customer must write to the email address info@massimorattalino.it.
The customer will be contacted for clarifications within 5 (five) working days of the request.
Applicable law and competent court
All disputes arising from this contract will be referred to a conciliation attempt at the Mediation Body of the Turin Chamber of Commerce and resolved according to the Conciliation Regulations adopted by the same.
If the Parties intend to appeal to the ordinary Judicial Authority, the competent court is that of the place of residence or elective domicile of the consumer, mandatory pursuant to art. 33, paragraph 2, letter u) of the code. cons.

The Application may contain links to third-party sites/applications. The Owner has no control over them and, therefore, is in no way responsible for the contents of these sites/applications.
